  • Has a Professional Civil Liability insurance policy and meets the legally established financial capacity requirements, all in compliance with Article 27.1, sections e) and f), in relation to the Third Transitional Provision of Law 26/2006, respectively.

PURPOSES:

  1. Applicants or contacts who fill out a web contact or quote request form and check the appropriate box, expressly consent and authorize the collection and processing of their personal data for the purpose of maintaining the mediation and professional advisory relationship for the coverage of insurable risks, including the corresponding profile analysis, as well as managing the contracting of insurance policies and monitoring their execution, compliance, and any incidents, and for financial advisory purposes, including profile analysis. Your personal data will be communicated to insurance companies to the extent necessary to provide the requested service, as well as to underwriting agencies or other brokerages as needed.
  2. In the case of form submissions, data collection will include the IP address of the device used for submission. Additionally, only if strictly necessary, health data may be included.
  3. If you consent by checking the corresponding box, your personal data will also be used to send you information and advertising, by any means (email, SMS, fax, letter, etc.), about products related to insurance and financial activities that we believe may be of interest to you.

Personal data will be retained for the legally established limitation periods (generally five years after the customer’s deactivation or ten years from the issuance of a life or investment proposal). Data will only be disclosed to third parties for legal compliance or with the data subject’s authorization.

This does not affect processing authorized by you for new contracts, or processing for advertising purposes, with such information retained unless you exercise your right to deletion or objection, and subsequently during the legal claim periods.

Based on the information provided, personal profile analysis may be carried out to offer effective advisory services. Data provided to companies or entities may be processed by them for automated decision-making, based on their risk analysis statistics. In such cases, these are legally permitted decisions, as they are necessary for entering into a contract with the company or entity.

If false data or data from third parties is provided without their consent, MORALES & ARNAL CORREDURÍA DE SEGUROS S.L. reserves the right to immediately destroy said data in order to protect the rights of the actual data subjects.

LEGAL BASIS: Law 26/2006 on Private Insurance and Reinsurance Mediation, or any future substitute regulation, authorizes the Broker to process the data of individuals who contact them, without needing prior consent:

  • Before entering into a contract: to provide independent, professional, and impartial advice, and to forward such data to the insurer or reinsurer with whom the corresponding contract is to be signed.
  • After the contract is signed, to provide the policyholder, insured, and beneficiary with requested information about any clause of the policy and, in the event of a claim, to provide them with assistance and advice.

All other purposes are based on your consent, both those related to the contract you sign with this Brokerage and any policies that may be formalized. Similarly, your consent is the legal basis for advertising-related processing you authorize, and withdrawing that consent will not in any case affect the execution of the Mediation contract.

RECIPIENTS: Personal data will only be disclosed to third parties to comply with legal obligations, for example, to the Tax Administration, or to insurance entities, underwriting agencies, or other brokerages as necessary for insurance quotations, policy subscriptions, or policy execution. Likewise, in cases required by regulation, they will be disclosed to the Ministry of Justice as the body responsible for the Insurance Contract Registry.

If insurance quotations or contracts are requested from foreign insurers outside the European Economic Area, international data transfers will be covered by the European Data Protection Regulation, or where applicable, the EU-US Privacy Shield Agreement.

SECURITY MEASURES: MORALES & ARNAL CORREDURÍA DE SEGUROS S.L. is committed to maintaining the confidentiality of personal data and its obligation to safeguard such data, and will adopt all technical and organizational measures to ensure the security of personal data and prevent its alteration, loss, unauthorized processing, or access, considering the state of technology, the nature of the stored data, and the risks to which it is exposed.
